Stewart York Heritage Luxury LLC ("SYHL," "we," "us," "our") is an independent secondary market and gray market reseller of pre-owned luxury goods. We are not affiliated with, authorized by, approved by, sponsored by, or in any way connected to any luxury brand, designer house, manufacturer, or brand-owned distribution channel. Nothing on this website should be construed as implying any such affiliation or authorization.

2. Trademark & Intellectual Property Notice

All brand names, trademarks, service marks, trade names, logos, and related intellectual property referenced on this website are the exclusive property of their respective owners. SYHL's use of these marks is solely for the purpose of accurately identifying genuine pre-owned products offered for resale. Such use constitutes nominative fair use and does not imply brand endorsement, sponsorship, partnership, or affiliation of any kind. SYHL makes no claim to ownership of any third-party intellectual property.

3. First-Sale Doctrine

The resale of genuine goods by independent parties is a legally protected activity under the first-sale doctrine as codified in 17 U.S.C. § 109 and applicable common law. Once a luxury brand places a genuine product into commerce, independent parties may legally resell that product without infringing the brand's intellectual property rights. SYHL operates in full reliance on and compliance with this legal doctrine.

4. Gray Market Goods

Some items sold by SYHL may constitute "gray market" goods — genuine products lawfully manufactured and sold in one market but imported and resold in another, or products sold outside brand-authorized distribution channels. Gray market goods are genuine and authentic; they are not counterfeit. However, they may not carry manufacturer warranties, may have regional differences, and may not be eligible for brand-sponsored service programs. Buyers are encouraged to review these considerations before purchase.

5. Authenticity Guarantee

All products listed on this website have been reviewed for authenticity prior to listing. SYHL maintains a zero-tolerance policy toward counterfeit goods. If any buyer has reasonable concern that a purchased item is not genuine, they may contact us within 14 days of receipt for a full refund investigation. If an item is confirmed non-genuine, a full purchase price refund will be issued. SYHL reserves the right to require return of the item prior to refund issuance.

6. Sourcing Disclosure

SYHL sources inventory through the following legal channels: (a) private individual sellers; (b) estate liquidations; (c) licensed B2B return and overstock auction platforms including B-Stock, BULQ, and similar services; (d) direct authorized retail purchase; and (e) pre-vetted customer consignments. All sourcing is conducted in compliance with applicable federal and state law. SYHL does not purchase from unauthorized or unverifiable sources.

7. No Warranty on Secondary Market Items

All items are sold as pre-owned, secondhand goods in the condition described in the individual product listing. Unless explicitly stated otherwise, items are sold without manufacturer warranty. SYHL provides its own authenticity guarantee as described above, but does not represent or warrant any item against mechanical failure, future wear, or defects not disclosed in the listing.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SYHL's total liability to any buyer shall not exceed the purchase price paid for the relevant item. SYHL shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of any item.

9. Governing Law

These disclaimers and all transactions conducted through this website are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Texas.
